Retro gamer Kenny Richey gets an Xbox for Xmas

KENNY RICHEY was given an Xbox for a Christmas present as he awaits release – because the last games consoles he played was a retro Atari.
The 43-year-old was given the gift by his brother Steven who lives near Putnam County Prison in Ohio.

His brother also gave him the war game Ace Combat 6 after Richey saw it advertised on television.

He said: "The last video game he played was an Atari. He saw Ace Combat 6 on TV and wanted to play it so my wife bought it for him."

Richey is expected to be set free within days after 21 years awaiting execution.

His lawyer Ken Parsigian told the Evening News that he hoped to agree a court date for tomorrow which would ensure Richey's release, although it may have to be on Monday or Tuesday.

Meanwhile, friends of Richey's ex-wife Wendy, 50, believe the couple – who have a son Sean, 22 – may get back together.

They had made plans to enjoy a family Christmas together before Richey took ill with chest pains and missed an earlier hearing.

Richey is finally set to secure his freedom after signing a plea deal over his alleged role in an arson attack that killed a two-year-old girl.

He is expected to fly into Edinburgh after being freed.

Let's see, Amnesty called this conviction one of the worst cases of a miscariage of justice they had ever seen. One of the major pieces of evidence presented was the petrol soaked mattress, which was dumped on the grounds of a petrol garage for a long time prior to it being tested by forensics. The girl had a recorded fascination with matches

Kenny may not be a saint, but if you had actually followed the case then you may have realised that there may be a case of reasonable doubt.

I have not read his book or the trial transcript, but I have seen enough to conclude that there has in this case been a miscarriage of justice, and if such an august body as amnesty has come to the same conclusion

I have been reading many of the comments people make to news articles on forums, and it still amazes me that despite this case being so widely reported on, people still don't have a proper grasp of the facts. Some of the wild suggestions make me wonder what people actually read.

Misinformation is still being spread around as the truth when it is not the truth.

I would like to clarify some things briefly one more time.

This campaign has fought, along with the attorneys that there was NO ARSON and therefore there was NO MURDER. There was NEVER any evvidence of arson. And ultimatley we won this huge part of the fight because the prosecution have DROPPED these two charges totally.

There are a few undisputable facts. 1. There was a fire in the apartment. 2. Little Cynthia Collins who had been left alone by her mother, tracigally died from smoke inhalation. 3. Kenny Richey tried THREE times to enter that apartment to try to save her. 4. Kenny Richey got the blame of setting the fire and has served 21 years in prison, most of it on Ohio's death row.

The evidence which Kenny Richey was charged and convicted on was not only tainted but mostly a lot of old wives tales and gossip. With no basis of any scientific truth or any truth for that matter.

After the fire on 30 June 1986, which was deemed to be electrical in nature, the apartment was emptied and the contents taken to the village dump. These contents including the living room carpet lay there for 36 hours before being dragged back out and taken to the police station and place uncovered in a police shed for almost 2 WEEKS.

In between these two weeks, on the 7th of July 1986, Kenny's clothing and belongings came back NEGATIVE for any accelerants.

The Fire Marshall said he would not say a fire was arson until he had completed his testing but still on the 10th July, almost 2 weeks before this carpet was tested Kenny Richey was indicted and charged with Aggravated Arson and Murder. With not

With not a shred of scientific evidence to back this up.

Finally by the end of July the carpet was finally rolled out in front of the police petrol pumps and left for a few days before samples where cut off it. A few came back with TRACES of petrol on it they said.

No one disputed this in court. Kenny's trial attorney at the time did not know what he was doing and did not get an expert to look at the so called evidence. Mr Kluge has very publicly admitted this.

Kenny was convicted and sent to death row.

Other arson experts looked at the evidence and concluded that there was no accelerants at all on the carpet. The Ohio Crime Lab had got things very wrong since they did not even use the proper testing procedures.

The general opinion was that this fire was possibly caused ACCIDENTIALLY by careless discarding of smoking materials. People had been partying in that house, drinking, smoking cigarettes and also dope.

Cynthia did also have a fascination with lighting fires and had lit a few previously.

At his trial, while this and many other facts where known to the prosecution and the attorney, was not raised.

In any possible arson case, ALL possible causes have to be ruled out first. This did not happen at all in this case.

Later on, much of the International Arson community got involved in discussing and looking at the case and not one of them supported what had occured in this case.

Tony Cafe, an emminent arson expert from Austrialia said that "what the state did in taking the carpet out of the dump was tanamount to being criminal." He also stated that had petrol been used on the carpet then there would not have been any carpet left to test.

These are the basic facts and nothing else you read on this is true. its all in the court documents and trial transcripts and a matter of public record.

Prosecutor Lammers, the current Prosecutor, continued until recently to say he had the stronger case when he knew fine well he did not. He

He has been forced to admit this by dropping the charges.

He has dropped the arson and murder charges completely. He knew he could not win this and Kenny would be found not guilty, as he should be.

So if the prosecutor can drop these charges, then it proves that Kenny Richey is indeed innocent of these charges. He did not kill anyone, and he did not set the fire as he has said from day one.

Kenny Richey is guilty of one thing and that is of stealing some flowers, which is where the breaking and entering charge comes from.

Don't you think that 21 years, mostly served on death row, is more than enough for walking into an unlocked nursery and stealing some flowers?

This entire case has been a travesty of justice and misinformation continues that travesty.

Some people will never be convinced because they want to believe that things like this do not happen. Well sadly they do and we need look no further than the Birmingham 6, Guilford 4, Sally Clark, Evans, and Derek Bentley in this country, amongst many others to see that it does indeed happen.

This campaign has fought long and hard to let the public see the true facts of this case and to fight these charges.

We never ever forget that a beautiful little girl so tragically died in this accidental house fire.

People do not have to believe me but before they condemn Kenny one more time, I suggest they look at the evidence properly. Its all on my site www.torley.org and educate themselves on it all.

karen I trust you will know that my postings on this matter have been in support of Kenny's case and that I detest the kneejerk reactionary responses all of whom
wish to end a life because a little girl died, for them
it matters not whose life as long as a life is taken for a life. It is for this reason that you will never get your reasoned arguments past their wall of ignorance and hate. They seek revenge, not truth or justice. It matters not now as Kenny will soon be returning to the land of his birth, whether the haradins of hate like it or not.
One thing is clear to me, however, by entering a plea of no contest, he let's the American justice system of the hook, for if he had been found not guilty at retrial they would then have been wide open to a massive compensation claim against them.
One matter you have raised causes me some confusion.

This does your case no good and therefore needs clarification before said haradins use it to dismiss
all other evidence.
I wish Kenny well upon his return and trust that he will return to a life of peaceful law abiding anonimity
and that the public and press will allow him to do so.

What the original cause of the fire was stated as being was electrical. This was by a Fireman named Len Heffner.

Later, much later I may add, (sorry for the confusion) After scientific review it was considered that discarded smoking materials caused the fire because there was no evidence of arson.

Cynthia did also have a fascination with lighters and matches.

The point being NONE of this was looked at PRIOR to any trial.

The state of Ohio were NEVER going to allow Kenny to get compensation. This entire deal is a face saving deal for the prosecution and its about as close as we will get to them admitting they where wrong.

Kenny is not admitting to anything. He doesnt have to. He gets to come home and Ohio gets rid of th e international embarrasment this case has caused.

I could not quite understand why there were so many cheap jibes on this thread from people who obviously have not followed this case at all. Those who call others ignorant and who ought to look to themselves first on that subject. I have over followed this case for a few years and read a lot about it and I truly believe in Kenny;s innocence. Thanks to Karen for explaining this all in detail to everyone and good luck to Kenny on his return.

Crikey - can you all not leave the guy alone? Let him settle down in peace and give him time to adjust. He's spent 21 years behind bars protesting his innocence (read the facts!) and now he's come home. At least give him the chance to live as normal a life that he can. He's entitled to make money after all he receives no compensation from the judicial system and he does have to live. And let us not forget that the mothe of this child got of scot free even though it has been well documented that she left this child on a regular basis with anyone or no-one!It's the mother who should have been castigated and imprisoned not Kenny Richey. He was just a scapegoat for a District Attorney's election campaign. Also don't forget the case of Louise Woodward who only had to spend over 200 hundred days in prison for allegedly killing a child. She was also innocent. Comparative sentences? I think not.

So for once let the guy get on with his life and the make the most of his freedom. Good luck Kenny
