Defiant Alexander insists: I won't go

WENDY Alexander was last night defiantly clinging on to her position as Scottish Labour Party leader after she was referred to the procurator-fiscal for not declaring donations.
Her troubles deepened after standards commissioner Dr Jim Dyer referred her to the fiscal for failing to register ten donations to her leadership campaign – worth more than £520 each – on the members' register of interests. Ms Alexander insisted she would not step down or follow the example of former work and pensions secretary Peter Hain, who left the UK Cabinet after being referred to the police for failing to declare £103,000 of donations.

If the fiscal pursues the case and she is found guilty, she may have to pay a fine of up to £5,000 and her career as an MSP – not just party leader – would be in tatters.

Ms Alexander said that she had received erroneous advice from Scottish Parliament standards committee clerks on 8 November, informing her that she did not have to declare the donations as gifts.

But a former Scottish Parliament standards committee chairman, Lib Dem MSP Mike Rumbles, suggested she might have already been in the wrong.

He said yesterday that Ms Alexander asked for advice from the clerks about the donations, received between August and September last year, after the 30-day period in which she should have declared them. Mr Rumbles added that if there was a "scintilla of doubt" then Ms Alexander should have declared the donations at the time.

The latest chapter in Ms Alexander's woes started on Friday when she "voluntarily" registered ten donations worth more than £520 on the members' register of interests at Holyrood.

This followed a ruling by Dr Dyer saying that she should have declared the leadership donations as personal gifts and that the advice she had received previously was probably incorrect. Dr Dyer had no choice but to refer her to the procurator-fiscal under the law.

The figure of £520 is important because MSPs must declare gifts worth 10 per cent of their salary or more.

The gifts declared included £999 each from GMB Scotland and Edinburgh entrepreneur Michael D Rutterford.

Ms Alexander also received £995 each from former Scottish Environmental Protection Agency deputy head Nicholas Kuenssberg; former Labour MP John Lyons; Phoenix Car Company; Strathvale Holdings Limited; former solicitor-general Neil Davidson; and City Refrigeration Holdings Ltd.

Another £990 donation came from businessman David J Pitt Watson, and £950 from developer Paul Green, which has since been returned.

Ms Alexander has so far refused to declare the donations under £520, although she received more than 20 financial gifts totalling £17,000.

Her problems began with the donation from Mr Green when it emerged in November that the Jersey-based developer was not on the UK electoral roll. The donation was raised by Ms Alexander's ally, Glasgow Cathcart MSP Charlie Gordon, who has since stepped down as party transport spokesman after it emerged he also received an illegal donation from Mr Green.

There has been speculation that Ms Alexander received donations for less than £1,000 so she and her team could avoid declaring them. Electoral Commission rules say donations of £1,000 or more must be declared through the commission.

The Electoral Commission has been investigating the donation affair since November, but has so far failed to make a ruling, although there is speculation that it may issue a report on Wednesday.

Ms Alexander said yesterday that she was frustrated with the time taken by the Electoral Commission. She said: "Everybody is as frustrated as I am by the length of time that it's taking the commission to come to a conclusion, but they need to be allowed to get on with their job."

She added she was unaware on Friday that she had been referred to the procurator-fiscal, but she described the whole issue as a "distraction" and wanted the procurator-fiscal to rule whether leadership donations should be declared, because they had not been revealed in previous leadership races.

"I certainly think it's a distraction, but the important thing is I'm getting on with my job," she said. "I am confident I will be cleared of any intentional wrongdoing. The issue is whether contributions to leadership election campaigns are gifts and that is a point on which the procurator-fiscal will, in due course, have to decide. In every other leadership election campaign, they've not been construed as gifts."

Ms Alexander also again insisted she had only followed advice from parliamentary clerks and, as such, should not have to resign.

"I think it's wholly inappropriate that if you follow the advice of the parliamentary authorities, that should be used as a reason to call for your resignation," she said. "I just want to get on with my job and tackling the issues that are important to the people of Scotland."

Ms Alexander's opponents in the SNP have continued to pile on the pressure. Nationalist finance secretary John Swinney claimed that the decision by the standards commissioner to refer her to the procurator-fiscal meant the Electoral Commission should follow suit.

He said: "Quite clearly, Wendy Alexander is in a very, very weak position as a result of the battering that she has been taking on this particular question for many weeks. If the parliamentary standards commissioner has felt it necessary to report Wendy Alexander to the procurator-fiscal, then the Electoral Commission has absolutely no alternative."

Fellow SNP MSP Roseanna Cunningham added: "Her position as Labour leader in Scotland looks like it is nearing the end-game. Peter Hain's resignation clearly increased the pressure on Wendy Alexander, and this referral to the procurator-fiscal leaves her in an extremely weak position. Saying that she must stay on for the good of the Labour Party is either bluster or arrogance. Perhaps Labour in Scotland genuinely do consider themselves to be above the law."

Ms Alexander's brother, Douglas, the Westminster secretary of state for international development, yesterday leapt to her defence. He said: "She has done exactly what was asked of her. As soon as the ruling was changed, she disclosed the donors and reported them to the Parliament."

He added: "Of course these are difficult headlines that none of us would wish to see, but that is why we have got to allow the Electoral Commission to get on with its job and, in the meantime, Wendy is getting on with hers."

A spokeswoman for the Crown Office confirmed a report was received on Friday by the area procurator-fiscal for Lothian and Borders and that this was being considered.

Possible successor is reported over failure to list gift

ANDY Kerr, the man tipped as Wendy Alexander's most likely successor as Scottish Labour leader, yesterday remained defiant after being reported to the procurator-fiscal for not declaring a gift.

The MSP for East Kilbride was referred to authorities by Dr Jim Dyer, the Scottish Parliament's Standards Commissioner, for failing to declare a gift of more than £1,000 from fast-food giant McDonald's.

Mr Kerr accepted hospitality worth £570 and tickets valued at £450 for the FA Community Shield, the traditional opening match for the English football season, over the weekend of 3-4 August last year.

However, he registered the gift four days after the 3 September deadline.

Dr Dyer has now referred Mr Kerr to the procurator- fiscal.

Ken McIntosh, a former Labour colleague of Mr Kerr, had to resign after failing to declare a trip to the Community Shield.

However, in a statement, Mr Kerr, Labour's public services spokesman, insisted all he was guilty of was an administrative error and he had never tried to hide the gift.

He said: "There was no attempt to disguise my attendance, I had attended previously, it was reported in the media and the event is attended by MSPs from my party and others.

"All of that being said, it would be clear to anyone that given the public knowledge of my attendance that this simply boils down to an error on my part, which I regret."

Reports last week said Mr Kerr was preparing a leadership campaign in case Ms Alexander had to step down.

Mr Kerr denied making any such plans.

appear to have lost any sense of morality.

In the last few months we have had the lowest form
of attacks :

. Wendy Alexander tries to use ring-fencing
as an excuse at scare mongering to "paint the First Minister as some kind of Dickensian villain,

in peril."

. Gordon Brown supports his Scottish cronies
and use his own children to attack " Holyrood Government's health spending, suggesting it was
responsible for a threat to cancer services at the
Royal Hospital for Sick Children in Edinburgh."

. Wendy Alexander admits to breaking the
law in accepting donations from an illegal source
but they try and deflect to a Bequest to the SNP.

. Now she tries to use a Kilsyth By-election
called due to the tragic death of the
sitting councilor Francis Griffin
as an indication of how Scottish Labour
is doing wonderfully well.

In addition to being incompetent sycophants they
appear to be turning into ghouls before
our very eyes. For Scottish Labour to full implode
at this point will be the best service they
can to for the Scottish people.

I really can't make up my mind whether I want her to go because she is disreputable or stay because she has a remarkable ability to damage Labour's cause - or at least hinder its reinventing itself.

I suppose the clincher is that she knowingly accepted the donation from a Channel Islands resident and even thanked him in writing to his home address there and that was illegal - not just poor judgment. Illegal.

It sounds as though her likely replacement will also have to go, which might actually damage Labour even more.

Does Labour actually have any MSPs who could maintain credibility or do we need a chain of resginations and by-elections to replace them with someone who has no political experience at all? That way, we could be reasonably sure that they have no skeletons in their cupboard.

Provided we first check them for criminal records.

I once applied for an administrative post at the Scottish Parliament.

It took them 3 months (YES- THREE MONTHS!) to write (by snailmail) and tell me I had not been successful in being selected for interview (after an application submitted directly to the Scottish Parliament website).

Any similarity between the world of electors and the world of MSPs is a coincidence beyond the odds of Turf Accountants.

Alexander's claim that her team had decided that they only wanted small donations because they didn't want to be seen receiving large donations, which might imply that some influence was being sought, rings hollow. For a start there is no indication the Wesminster Labour Party hasn't accepted large donations, and if what she says is true surely it would have been minuted and there should be documentary evidence of this, so where is it?

The key point here is the date WA's enquiry about donations went to the standards committee. If the committee - who certainly have questions to answer - had, at that time, stated that the donations had to be declared and she had complied immediately then she would be in exactly the same position as she is now; guilty of failing to declare the donations within the required time. This, of course, makes her letter and the committe's response irrelevant to her crime and I question if anything would ever have been declared but for the original leak of Mr Green's donation.

All this ignores the fact that her leadership bid was unopposed and,therefore, begs the question why was a campaign fund necessary. Seems to me an unnecessary extravagance with other people's money. Just as one of her first actions on becoming leader of the Scottish Labour party was to demand more money for herself.

That she has been given so much support from within Scottish Labour speaks volumes and it is very sad to see the Labour party drift so far from the high ideals and morals on which the party was founded.

It was found out later that the journalists from the Sunday Mail had 'manipulated' the story and stwisted some of the facts. The girls that were involved denied most of what had been reported and had felt duped
Without doubt the Sunday Mail reporters are not very welcome in the islands

I would have been prepared to accept her staying on if she had come clean and simply admitted a bungle. But her actions, even now, demonstrate that this was no bungle. Judging by the amount of time these Labourites spend helping the police with their enquiries, they must all be model citizens, positively dripping with honesty and integrity.

How lucky we are to having them represent us in both parliaments!

Wendy, with her huge intellect, massive moral compass and not very large mouth, is a credit to all sons and daughters of the manse.
A veritable pillar of the community, she is regarded with the greatest of esteem by all pre-pubescent schoolgirls, caterpillars and Scotsman political commentators.
A mother of two small children, she is about to show her admirable maternal instincts by resigning her day job in order to spend more time with her family, much to the joy of her SNP supporting husband.

Andy Kerr, former Health Minister, known particularly for his messianistic desire to close hospitals outwith his own constituency, and up until last week the heir apparent to the sainted Wendy, now has the problem of how to dispose of £1,000 worth of wee plastic toys, courtesy of a well known burger chain.
Donald McDonald may well be a registered donor to the SNP, but it appears that Ranald McDonald Burger’s donations to the Labourites can be conveniently overlooked as being merely an “administrative oversight”.

Douglas Alexander whilst being interviewed on “The Andrew Marr Show” sounded like the he was preparing for opposition.

This is the natural position of the Labourites in Scotland.

Scotland previously chased the Tories, now we are chasing the Labourites.

Oh happy days!

The usual blurb from our politicians when caught 'not up to scratch!'

When will they realise we dot pay them for doing wrong (especially with such feeble excuses!) - but getting things right!

Sounds very much like another case of the Hain 'Incompetence' - seemingly not considered a very serious problem by their great 'dithering and bottling' Leader - the Mighty Gordon, possibly New Labours shining example of 'Incompetence'- by the look of the way things are in the Country!!

£180,000 of the public purse was used to educate this Labour ' team ' on the laws regarding donations, a policy which they themselves introduced. What it now looks like is they used this information in finding ways to totally ignore or bend these laws for their own benefit.

Or, in the weeks that these courses were available to them, did they just take a holiday ?

Or, are they just so dumb, it did'nt sink in ?

Either way, obviously a total waste of public money.

We need politicians with intelligence/flair and the ability to make real positive change. I’m not saying Wendy fits the bill…..but she needs to be given a good run at it to show what she’s capable of. What hope for any party or leader when they can be hounded for the smallest issue. Move on and get to the real priority items. This story is very tiresome and sums up nicely the whole small minded approach we have. ZZZzzz.

Folk’s I believe that there are a number of problems that Wendy and her “friends” have inadvertently made.
One that the rules for reporting to the Electrical Commission; second the Rules of the Scottish Parliament, being both totally different and yet the same.
The rules for the Electrical Commission require that any “Gift” or “Donation a £1,000 or more must be reported within 30 days of receipt of such “Gift” or “Donation”.
The Rules for the Scottish Parliament are that any “Gift” or “Donation” over £525.00 or 10% of an MSP’s salary must be declared and reported within 30 days.
Now having been in receipt of £180000 to educate both the MP’s and MSP’s the Labour party must be able to convince you and me that it was spent on that Education.
We have Wendy and her “friends” saying that the £950.00 cheque from the Channel Islands was an oversight and not a deliberate action to deceive.
Then along come The Commisioner for Standards at Hollyrood and reminds “Wendy and Co”. that the limit for MSP’s of all Parties that the limit is £525.00; oop’s ! Wendy then reports a number of donations that funny enough appear to be just below the Electrical Commission’s limit; but still well above the Scottish Parliaments limit and well out of the 30 time limit.
Now having admitted that she broke the law with regard to the Green cheque on camera and before the Scottish people, she now wants us to believe it was unintentional.
Great the along comes the Commissioner and Wendy finds she has no defence to the charges that Wendy and Co were out to deceive with the number of funny cheques she had not declared to the Commissioner, now she has to await both the Electrical Commission’s decision ( a new Labour whitewash team of placemen) Ha! Ha! Who having found themselves out placed by the Standards Commissioner and the Procurator Fiscals Office.

The fact that Wendy admits to referring the matter to the Parliamentary Clerks, surely, indicates that she knew that there was some doubt over the donations. Why did she not simply declare them then and avoid all this? The answer: she is devious and not very wordly wise. Moreover, it shows contempt for the voters and the Scottish Parliament. She deserves what is coming to her. How can such a person lead her party let alone lead the country? As for ‘unintentionally’ breaking the law, does that mean that if I claim not to have seen a speed sign that I only ‘unintentionally’ broke the speed limit and should be forgiven? I don’t think so!
BTW, #s 8 and 12, if someone took £950 from you or an employee stole such a sum from a company would it still be a ‘storm in a teacup’? It is a matter of principle and trust and it appears to me that most labour MPs and MSPs lack that essential commodity. How many donations of £950 have to be received illegally before it stops being simply a ‘storm in a teacup’?

This could easily be resolved in future by ALL donations and gifts to MPs, MSPs, MEPs and other such public figures funded by taxpayers (servants of the people) being registered within 30 days. That way no one can say 'we didn't know' or 'we weren't sure if it should be declared or not'

This isn't about £950 or £520. It is about a leader who has handled an inconsequential matter so poorly that she now finds herself in a position where resignation should automatically follow. That it hasn't is further demonstration of an individual who is way out of step with the views of the electorate.
The list of follies and arrogance is lengthening. From unintentional wrongdoing to "it was a clerk what told me to do it", Alexander might focus on the very simple fact that she is being shredded over an election she won uncontested. As I recall at the time, the money raised was supposedly for a "victory tour". Dear oh dear.
I would hope that politicians learn that people are increasingly frustrated by politikspeak. Interviews where characters such as Jackie Baillie turn up on tv and say "well you know" and "if you let me answer the question" - surely by now such prevarication is way beyond parody? As is the stock phrases of "standing firm" and "determined to clear her name". And yet they still come, boring us all with pitiful excuses for slippery behaviour.
In all of this, from Hain to Conway to Alexander, you get the real feeling that the main problem is getting caught. At the time of the act, people either appear to believe it is tickity boo, or worse, think it doesn't matter. Yet willfully raising £999, just to keep it below the radar, seems duplicitious, irrespective of the source of the donation.
Of course it will never happen, but Labour needs to start from scratch. Look for people with ideas and true intellect. The party is full of placemen, cooncilors and career politicians, and it seems to me that they are all increasingly incapable of standing for anything other than self preservation.
