Nurses want right to halt treatment of Hannibal

NURSES plan to appeal to the European courts for the right not to treat notorious patient Donald Gibson in a legal first.
They say they are sick of being subjected to a torrent of abuse as they continue to give him life-saving kidney dialysis treatment.

It follows Gibson, dubbed Hannibal by staff because of his aggressive behaviour, walking free from court after sending an allegedly threatening letter to a security guard.

As reported in the News on Saturday, the Court of Session found Gibson had attempted to scrawl out the words: "If you turn a blind eye to this then I say to you it's people like you that turn people into serial killers." Health chiefs had claimed that the words were still clearly legible.

Unison, the public sector union, now plans to take his case – and a similar one from the London area – to the European courts to try and set a precedent.

Lawyers will press judges to decide which should come first, Gibson's right to life or NHS Lothian staff's right to work without the fear of intimidation that he creates.

Tom Waterson, chairman of public sector union Unison's Scottish Health Committee, said: "It seems the courts are falling over backwards to assist Donald Gibson in his campaign to threaten, abuse, and physically and verbally assault our staff. We are pursuing it through our lawyers and plan to take it to the European courts."

It follows the Scottish Public Services Ombudsman asking health chiefs to provide a television for Gibson after he complained he needed some distraction from his fear of needles, at the end of last year.

Hospital bosses were also ordered to tell nurses to stop staring at Gibson and to put up a curtain to prevent other patients looking at him.

Mr Waterson said: "We are very unhappy. We feel we have been let down by the establishment. It is completely unacceptable.

"For people to still face abuse and intimidation when they are trying to save lives is appalling. We will not stand by and let our staff be abused in this manner."

Unison has argued previously that Gibson should not receive treatment if he continues to threaten staff.

Mick McGahey, Unison branch secretary for the Lothian University Hospitals Division, said: "This man should not be receiving treatment at all. He has threatened our members with physical violence and caused so much heartache and stress."

An NHS Lothian spokesman said it would be "inappropriate" to comment on an individual case.

However, Shona Robison, now Minister for Public Health, warned Gibson last year, saying: "If someone needs treatment that's not life-threatening they should demonstrate they can behave in an appropriate manner to deserve care."

he should not receive special treatment at all. If he can't behave he should be arrested and charged.

Nobody should be fearful of him.

My taxes are not to pay NHS to treat him differently and supply extras for him.

MOney could be used to pay staff more!

Saw him once going into hospital and just pushed past anybody in his way - very threatening he was.

He is just the tip of a very large iceberg when it comes to NHS staff and ofcourse other workers being threatened and abused while trying to earn a living. Crazy thing is, I've foun most of the people whyo do this do not contribute to society in any other way, they just take!

No matter anyone's financial or employment status, they are entitled to NHS treatment.

In saying that, if a person behaves in that kind of manner the staff should have the right to refuse him service.

If he walked into a bar/restaurant/cinema/any other establishment and carried on like that, he'd be thrown out and barred.

It shouldn't be any different. If he's already been warned and he doesn't change his attitude then it's his problem.

Medical staff have enough to do with very long hours and bad pay without having to put up with that kind of behaviour.

Make a stand!

It shouldn't come to someone getting injured or worse before this guy is stopped.

And meanwhile, how many other people in the hospital are suffering as this bully has every available nurse and doctor running about catering to his every whim. Damn right he should be refused treatment if he is being intimidating. In fact, he should be arrested and shoved in a cell and see how long he lasts. NHS staff have the right to do their job without this behaviour. They put up with drunks, bullies, idiots with knives etc every day so for them to take this case forward this guy must be really bad.

just incredible that this f....n nutter is allowed to be breathing never mind treatment. he should taken off the streets and left to die !residents of broomie be aware this crack pot lives there, and is a danger to everyone. the law as usual lets scum like this be free.
when decent people wait weeks for treatment. the staff at the royal should refuse point blank to give him any help. the sooner the b.....d dies the better

Could we not get him to the top of the waiting list for a new Kidney. This would stop him having to go to the hospital quite as often and therefore not annoy the staff. Alternatively we could crush his testicals in a very tight vice until he can behave like a normal human being. I can see only 2 choices. I personally would opt for the latter but I'm not a doctor. I do have a vice. UK 2008 you couldn't make it up.

Most of us, including me, are very grateful to receive treatment on the NHS when it's necessary. I can manage to say thank you to auxiliary, nursing and medical staff at every stage of my treatment - and that's not even for life saving treatment! If this person (if this weren't in print I may not be so polite) can't be civil and continues to abuse our NHS staff then he should not be allowed treatment. If he persists in behaving this way then surely he forefits any 'human rights' he may have? Britain has gone mad - it's time to apply a little commonsense. If he can't behave in a civilised manner - no treatment!

He was found guilty of assaulting a nurse trying to treat him, a few months later he racially and verbally abused a security guard. ( thats just some of the cases that went to court )
He is treated in isolation as he is so threatening.
The man has an ASBO to stop him continually abusing staff and patients, in spite of this he has submitted 20 odd complaints to The Ombusman. I believe non of them were substantiated

Yes - it's me - I am the guy that you are all talking about.

I am very saddened to hear some of your comments.

I thank my good friend Willoughby (comment 19 and 22) for supporting me, and as you pointed out I have now hired my legal team.

I have taken out a court injunction against the Evening News for the comments raised in this article and if successful they will not be able to publish any more fairy stories about me.

I have never assaulted any nurses, or indeed anyone who works within the healthcare sector, and I deny all of the allegations made against me.

If he has been assessed as having a medical or psychiatric condition which means he can't help how he behaves, then the staff will have to find a way of treating him. If not, then he's entirely responsible for his own behaviour and his options should be a) behave and get treatment or b) behave badly and not get treated.

I'll take the word of Tam Waterson and Mick McGahey over Donald Gibson any day.

As for not assaulting anyone - explain why you have demanded all and sundry that a special room has had to be built to hold you in. I'd call it threats, bullying etc from you and fear from the staff.

You are an excuse for a man. Receving life saving treatment, by medical professionals who do what they are paid to do, and yet being the vile, predator that you are, you abuse them even when they save your life on a regular basis. And what makes matters worse is that you receive legal aid to fight those that have had enough of your nonsense. And to add to that you are a convicted rapist, who has caused pain and suffering for an other, maybe even others. Guantanemo bay offers free medical care, maybe you should e sent there. Though the terrorists would probably want away from you!!!!!!
