My goodness. I never thought that the day would come when people in Scotland were not responsible for their own actions. Welcome to the litigation process as we know it in the USA. This is the thin edge of the wedge, as people try to collect from others for their own foolishness.

Daft daft daft. Pavements should be kept in good repair but anything which happens to drunks is self inflicted injury and hence the NHS should be sueing her for their costs

That Cardiff has had to pay over two million doesn't surprise me. Our footpaths are not just in a bad state of reapair but many of them are dangerous. The Council is trying to get a grip on things and they only seem to have realised how dangerous the paths had become when Steven Cram's brother, Kevin, died in a fall when jogging - the most likely reason for the fall was that he had tripped on loose paving stones. The other problem is that the Council has been replacing a lot of the older paving stones (which were dangerous) but the new ones take a bit of time to bed in which means that there are a lot of fairly loose paving stones around for people to trip up on!

She was voluntarily drunk and incapable. Society DOES NOT have the duty to protect people like that. The council should have sued HER for any damages she may have caused.

The law needs to be change - there has to be some responsibility on behalf of the claimant - proving they took all reasonable measures to avoid the avoid the accident.

Indeed just make it like the laws for defamation - the person claiming most show the accident occurred in circumstances "in which right-thinking members of society" another party was to blame.

I would like to read a follow up article on this story, about how this granny and her friends were prosecuted for perjury for lying about 'only having three glasses of wine'. I would also like to read about how she used the £7,000 to repair the fences in the local park after she was released from prison.
I'd say the same to my granny too!

Sheriff Kiernan McLernan should have booted her case out of court. She was more than 80% responsible, she was 100% responsible.

The stupid woman is old enough (and no doubt ugly enough) to take responsibility for her own stupidity.

I hope the local authority lodges an appeal and takes her to the cleaners for costs.

And I will be expecting Sheriff Kiernan McLernan to resign with immediate effect. It does not do anyone any good to allow claims of this nature---however small the money involved.

WHAT IS THE DIFFERNCE BETWEEN THIS SMELLY OLD DRUNK AND ANY YOUNG NED ON BUCKFAST - NONE.

The award is fair. The compensation was reduced to take account of the pursuer's contributory negligence.

If the council had not been negligent it would not have had to pay anything at all. It was blameworthy and it is right that it should obliged to partly compensate for the loss and injury suffered.
