COURT proceedings against former Death Row Scot Kenny Richey were cancelled by the Crown Office today.
Richey had been arrested and charged with breach of the peace on Saturday after allegedly climbing onto a warehouse roof.
He was later released on the condition he appear at Edinburgh Sheriff Court today.
Richey's lawyer, Peter Winning, said proceedings had now been cancelled and did not yet know if the Crown Office would take any further action.
A Crown Office spokeswoman confirmed: "He won't be appearing in court today".
Richey, who has angina, spent hours under police guard in hospital with chest pains following his arrest on Friday night.
Hours after being released on Saturday, he was attacked and beaten up outside his Edinburgh home by a man claiming to be a professional boxer.
Mr Winning said Richey had a suspected broken nose:
"He got beaten up outside his house. He's taken quite a hammering."
